Your Questions About Personal Training Insurance

Mary asks…

How can I protect myself, in my personal training business, until I get Insurance?

I recently took on a client who I will be training from my house. I’m going to see how it goes, before I take on more clients, so I don’t have insurance or a lawyer or anything yet, she wants to start training right away, and I don’t want to invest in an expensive coverage until I know this is something I’m going to keep doing, . But I need to write up a contract for both the exchange of services and something to cover me in case of any injury, etc. Can I write something like “I will not sue my trainer for any injuries that may occur?” She’s nice and I’m not really worried, but I also don’t know her so well.

Drae answers:

Go to the search engine of your choice and type in “liability waiver”. You will get thousands of examples of liability release forms. But understand that just because somebody signs your release form it does not mean that they can’t sue you. No one can sign away their right to sue.

They could sue based on the fact that the waiver was not validly signed, that your gross negligence made the waiver invalid or they could assert that the injury they suffered was not covered by your waiver. Those are just a few assertions that could be made. A lawyer would have many more.

If a suit is filed you still have to defend against it even if the suit is completely groundless. This is why people buy liability insurance and have clients sign waivers.

Carol asks…

I need liability insurance I am a personal chef cheapest route?

I refuse to pay 700 dollars plus for these so called personal chef training associations. Are they going to do my marketing and guarantee me clientelle, No. I just need to know if anyone knows were I can get some cheap decent liability insurance in southern California

Drae answers:

Well, $700 is the cheapest way to go.

If you go to an independent agent, he’ll put you out to market, and I’d be shocked if you found ANYTHING for under $1500.

Daniel asks…

How do I start my personal training business?

I know I need clients. I just don’t know how to start the actual business. Do I have to register my business anywhere? where? Do I need insurance? I want to start a pt business where i go to the client. I meet them at their homes, a park, a trail, beach, wherever. So what do i need, how much money, etc.

Drae answers:

Go to score.org/ and in the upper left hand corner, enter your zip code. On the next screen, you will get information on the nearest SCORE chapter. Call them and arrange for a free meeting with a volunteer SCORE counselor. They will guide you through the process.

SCORE is a nonprofit association dedicated to entrepreneur education and the formation, growth and success of small business nationwide. SCORE is a resource partner with the U.S. Small Business Administration (SBA).

SCORE has 389 chapters in locations throughout the United States and its territories, with 10,500 volunteers nationwide. Both working and retired executives and business owners donate time and expertise as business counselors.

Chris asks…

If a gym charges your health insurance for you sessions under medical necessity is this fraud?

I went with my friend to sign for personal training, and the front desk man convinced me that I could get free personal training through them. I just had to give them my insurance card. Later he called me told me I would get unlimited sessions if I just visited their doctor so he could put me on MEDICAL NECESSITY. I was wondering how this would affect my insurance, besides bombarding it with claims? It all seems very shady to me.

Drae answers:

I see a HUGE red flag here. Your instincts are absolutely correct.
